Stephan A. Barber is a Partner and Director of Litigation/Senior Trial Counsel at JRG Attorneys at Law. He specializes in the areas of business and real estate litigation, personal injury and property damage litigation, employment and labor law, products liability and warranty, insurance law, construction contract and defect, contract/UCC, and indemnification contracts.

In 1972, Stephan received a bachelor’s degree in economics at the University of California at Santa Barbara (UCSB). He obtained his Juris Doctor degree in 1976 from University of the Pacific, McGeorge School of Law and was admitted to the California Bar in the same year. Stephan is also admitted to practice in the Federal Ninth Circuit Court of Appeals as well as the Northern, Eastern, Central, and Southern District Courts.
During Stephan’s 42+ years as a civil trial attorney, he has tried nearly 100 cases in 17 California counties and the Federal District Courts in California. His trials have involved claims against product manufacturers and installers, personal injury for plaintiffs and defendants, real property disputes, insurance contract and bad faith claims against insurance companies, and commercial contracts. He has also represented clients in several arbitration and government agency administrative proceedings.
In addition to his trial court work, Stephan has handled numerous appeals in the California Supreme Court, all of the California District Courts of Appeal, and the Federal Ninth Circuit Court of Appeals. He has prepared and presented briefs and oral argument in various courts of appeal approximately 15 times and has three published appellate decisions: American Bank & Trust v. Community Hospital (California Supreme Court 1984 addressing the periodic payments statute in MICRA), Kaiser Engineers, Inc. v. Grinnell Fire Protection Systems Co. (1st DCA 1985 addressing employer indemnification agreements), and Morales-Simental v. Genentech (1st DCA 2017 addressing course and scope of employment). In addition, he has been trial and appellate counsel in three significant appeals where the court did not publish the decision though Stephan’s client prevailed: Seagate Technologies v. St. Paul Fire & Marine (9th Circuit 1995 addressing insurance coverage for claims against high tech companies), Rice v. Rancho Palma Grande HOA (6th DCA 2015 addressing the Davis-Sterling Common Interest Development Act), and Henriquez v. Honeywell International Inc. (2nd DCA 2016 addressing standing for wrongful death plaintiffs).
Some of Stephan’s past and present clients include the County of Santa Clara, County of San Benito, Honeywell International Inc., Genentech, Minimax USA, Consolidation Fire Protection, Cosco Fire Protection, Star Industries, Inc., INX International Ink Co., Sun Chemical Corporation, Watts Water Technologies, Inc., Tyco International, Ltd., Santa Clara Swim Club, Los Angeles World Airports, Environmental Service Partners, and Star Industries. He has represented many companies, partnerships, and individuals in various industries such as manufacturing, electronics, security, fire protection, hotels/resorts and property, construction, real estate, printing and specialty inks, casualty and property insurance, and plumbing/water transmission products.
Since 1980, Stephan has acted as an arbitrator and been a speaker at numerous legal seminars. In 1984, he joined Ropers, Majeski, Kohn & Bentley (RMKB) after being a partner in a San Jose law firm. Before joining JRG Attorneys at Law, Stephan was a senior partner in RMKB’s San Jose office. He has earned the highest possible rating for legal ability/competence and professional ethics from Martindale-Hubbell.
Due to his experience and reputation in the legal community as an accomplished litigator, Stephan has obtained immense success by helping his clients obtain favorable settlements without incurring the risk and expense of court litigation or arbitration.
Stephan is a third-generation Californian. He has been married for 35 years to Lauren. They have an adult daughter who is a special education teacher and an adult son who is strength and conditioning coach. They also have two young grandchildren.
